JUV’AE CLINICAL FOUNDATIONS COURSE – TERMS & CONDITIONS
Binding Contractual Agreement
This Agreement (“Agreement”) is entered into between Juv’ae Pty Ltd and the enrolling nurse (“the Trainee”) and constitutes a legally binding contract. By enrolling in the Clinical Foundations Course and submitting payment (whether partial or full), the Trainee agrees to be bound by the terms outlined below.
- Fees, Deposits & Payment Obligations
1.1 All payments and deposits made toward the Course are strictly NON-REFUNDABLE and NON-TRANSFERABLE, regardless of reason, including change of mind, illness, or inability to attend. Nothing in this Agreement limits the Trainee’s rights under the Australian Consumer Law (ACL). If Juv’ae is required by law to provide a remedy (such as a refund or reschedule) due to cancellation by Juv’ae, those rights will be honoured.
1.2 Upon booking, the Trainee enters into a binding contractual obligation to pay the full course fee, which remains payable in its entirety regardless of attendance, completion, or withdrawal.
1.3 Full payment must be received at least 30 days prior to the first day of training. If full payment is not received by this date, Juv’ae may, at its discretion, allow the Trainee to attend Day 1 only, based on the amount paid. However, this does not reduce the Trainee’s obligation to pay the full course fee.
1.4 Fees are non-refundable because resources—including clinic space, staffing, and patient models—are booked specifically for the Trainee’s allocated session. These costs are incurred regardless of attendance and cannot be reallocated at short notice.
1.5 Juv’ae reserves the right to amend the course fee and/or introduce, modify, extend, or withdraw promotional pricing or offers at any time and without prior notice. Promotional offers are subject to change at Juv’ae’s discretion and may be extended or concluded earlier than originally indicated.
1.6 The course fee applicable to the Trainee is the fee in effect at the time the Trainee pays their deposit. Once the deposit has been paid, the course fee for that Trainee is fixed and will not be adjusted, regardless of any subsequent changes to pricing, promotions, discounts, or extensions offered by Juv’ae.
- Requests to Change Training Dates
2.1 Change of training dates will not be permitted except in cases of genuine extenuating circumstances that demonstrably affect the Trainee’s ability to attend their scheduled session.
2.2 In such cases, the Trainee must submit a written request to the Directors of Juv’ae, accompanied by supporting documentation (e.g. evidence of emergency) within a reasonable timeframe prior to the scheduled training date. Approval is not guaranteed and will be considered on a case-by-case basis at the sole discretion of Juv’ae’s Directors.
2.3 If a request to change dates is not approved, or if the Trainee fails to attend without approval, the Trainee forfeits the allocated training session. However, the full course fee remains payable.
- Model Responsibility & Sign-Off
3.1 The Trainee is solely responsible for sourcing the required number and type of patient models.
3.2 Juv’ae accepts no responsibility for any inability to be signed off due to a lack of models. Failure to meet model requirements will not entitle the Trainee to a refund, extension, or discount.
- Juv’ae Academy Access (Post-Training)
4.1 Access to the Juv’ae Academy is a complimentary privilege extended to Trainees who complete the Course and continue their clinical relationship with Juv’ae. It is not included in the training fee and may be suspended or revoked at Juv’ae’s discretion. This complimentary access is available for up to one (1) month following the completion of training, after which the Trainee’s Academy account will be closed unless eligibility requirements have been met.
4.2 To be eligible for continued post-training access to the Juv’ae Academy, the Trainee must sign a Software Sub-Licence Agreement and provide a valid Australian Business Number (ABN) and Clinic Address to Juv’ae within one (1) month of completing the Course. If these requirements are not met within this timeframe, access will be temporarily suspended.
4.3 Access may be reinstated at any time upon execution of the Software Sub-Licence Agreement and provision of a valid ABN and Clinic Address.
- Legal Standing & Acknowledgement
5.1 This Agreement constitutes a contractual obligation under applicable Australian consumer and commercial law. The Trainee acknowledges that this agreement is enforceable and that non-payment of course fees may result in debt recovery proceedings.
5.2 Juv’ae reserves the right to amend operational policies, provided such amendments do not affect the Trainee’s existing contractual obligations.
- Acknowledgement & Agreement
By submitting payment or enrolling in the Clinical Foundations Course, the Trainee confirms that they:
- Have read and understood this Agreement in full;
- Acknowledge their binding financial and contractual obligations;
- Accept all terms set forth above.
